1. Agreement
By signing up as an Affiliate in the Wildfire Affiliate Program (“Program”), you agree to these terms and conditions (“Terms of Service”). Wildfire Oil may update or change these terms at any time. Continued participation constitutes your consent to such changes.
Violation of these terms may result in termination of your account and forfeiture of outstanding affiliate commissions. Use the Program at your own risk.
2. Summary

- Affiliates earn commissions on tracked sales via their unique links (30-day cookie).

3. Account Terms
- You must be 18 years or older to join the Program.
- Participation is open to residents of Australia and other approved countries.
- Bots or automated account registrations are prohibited.
- Logins must be used by a single individual and not shared.
- Provide accurate information, including legal name and email address.
- Maintain the security of your account and password.
- No multiple accounts or self-purchases to earn commissions.
- Comply with applicable laws, including copyright and anti-spam.
4. Links and Graphics
- Upon approval, you receive a unique Affiliate Code.
- Use only banners, links, and graphics provided by Wildfire Oil.
- Ensure your links use the correct tracking format.
- Send traffic to the most relevant product or category page where possible.
- Wildfire Oil is not liable for commissions lost due to incorrect link usage.
5. Referral Fees and Payment
- Commissions are earned when a customer completes a purchase through your Special Link.
- Cookie window: 30 days from the first click (last-click attribution). Orders placed after this window are not eligible.
- Commission rate: set individually based on each application and credentials, and may vary by affiliate or campaign.
- Payments are only made for tracked and recorded sales.
- The minimum payout threshold is $50 AUD. Earnings below this threshold roll over to the next month.
- Wildfire Oil may adjust your individual commission rate with prior written notice.
- Commissions generated via fraudulent, misleading, or otherwise non-compliant practices are disqualified.
6. Identifying Yourself as a Wildfire Affiliate
- Do not issue press releases without approval.
- Do not misrepresent your relationship with Wildfire Oil.
- No purchases for personal use via your own affiliate links.
7. Payment Schedule
- Payments are processed monthly for accounts exceeding the $50 AUD threshold.
- Payment method: PayPal only. Ensure your PayPal email is correct in your profile.
- Any PayPal fees or currency conversion charges are the affiliate’s responsibility.
- Wildfire Oil is not liable for failed or delayed payments caused by inaccurate account details.
8. Customer Definition
Customers referred through the Program are deemed Wildfire Oil customers. Wildfire Oil retains the right to adjust pricing and policies at any time. Affiliates should avoid publishing specific prices as these may change without notice.
9. Affiliate Responsibilities
As an Affiliate, you are responsible for:
- Operating and maintaining your website or marketing channels.
- Ensuring compliance with third-party hosting agreements.
- Posting accurate and lawful content, with clear disclosure of affiliate relationships.
- Complying with privacy and data laws relevant to your audience.
- Keeping account details up-to-date; failure to do so may result in suspension or termination.
10. Compliance with Laws
- Australian Consumer Law (ACL): no misleading or deceptive conduct; disclose affiliate relationships.
- Spam Act 2003 (Australia): consent required for commercial electronic messages.
- Privacy Act 1988 (Australia): handle personal information lawfully and transparently.
- Queensland Fair Trading Act 1989: comply with fair trading practices within Queensland.
- Advertising standards: ensure promotional materials meet platform and regulatory guidelines.
- International affiliates: comply with local laws; in Program matters, Australian law prevails.
11. Term and Termination
- The Agreement begins upon acceptance and continues until terminated by either party.
- Either party may terminate at any time with written notice.
- Upon breach, Wildfire Oil may terminate immediately. All earned commissions, including those exceeding the $50 AUD payout threshold, will be forfeited.
- Upon termination, remove all Special Links, promotional materials, and Wildfire branding from your channels.
12. Relationship of Parties
Affiliates and Wildfire Oil are independent contractors. This Agreement does not create a partnership, joint venture, or employment relationship.
13. Limitations of Liability
Wildfire Oil is not liable for indirect or consequential damages, including lost revenue or profits. Total liability is limited to the referral fees paid to you under this Agreement.
14. Disclaimers
Wildfire Oil makes no warranties regarding the Program or its products and is not liable for interruptions or errors in the Program’s operation.
15. Dispute Resolution
Before commencing arbitration, the parties will first attempt to resolve any dispute through good-faith mediation within 30 days of written notice of dispute. If not resolved, the dispute will be finally settled by confidential arbitration under the rules of the Australian Centre for International Commercial Arbitration (ACICA). Intellectual-property disputes may proceed directly to court. This Agreement is governed by the laws of Queensland, Australia.
16. Intellectual Property
Affiliates may only use Wildfire Oil’s trademarks, logos, and promotional materials as provided. Unauthorised use, modification, or distribution is prohibited. Wildfire retains all intellectual property rights.
17. Unpaid Commissions Upon Termination
If your account is terminated for reasons other than a breach of these terms, Wildfire will pay any outstanding commissions exceeding the $50 AUD threshold. Commissions below the threshold will be forfeited.

19. Changes to Terms
The current Terms of Service will be available on the affiliate dashboard. Affiliates will be notified of significant changes via email or account notifications.
20. Use of Artwork and Product Images
- Use only the promotional materials, artwork, and product images provided by Wildfire Oil.
- Ensure your promotional materials remain up-to-date.
- Upon notification, implement requested updates within 7 calendar days; failure may result in suspension or termination.
21. Use of Affiliate Content
By participating in the Program, you grant Wildfire Oil a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt (e.g., resizing or light edits), and distribute content you create to promote Wildfire products (“Affiliate Content”). This may include images, videos, blog posts, reviews, and social media content.
Wildfire Oil may feature Affiliate Content on its websites, social channels, emails, retailer sell-in materials, and paid advertising, with creator credit where reasonably practicable. You retain ownership of your content and warrant that you have all necessary rights to grant this licence.
22. Prohibited Practices
- Brand bidding: no bidding on “Wildfire”, “Wildfire Oil”, or close variants in search ads (including misspellings).
- Coupon/discount abuse: do not post or seed unpublished codes on coupon sites, or advertise “best price” claims without approval.
- Misleading or medical claims: no health, therapeutic, or performance claims; comply with Australian Consumer Law and platform policies.
- Undisclosed endorsements: clearly disclose affiliate relationships (e.g., “#ad”, “affiliate link”) and follow local disclosure rules.
- Spam & unsolicited messages: no unsolicited emails or messages in breach of the Spam Act 2003.
- Cookie stuffing/link hijacking: prohibited, including hidden iframes, pop-unders, toolbars, or forced clicks.
- Self-referrals & order manipulation: no commissions on your own purchases or orders made for others to trigger rewards.
- Impersonation & brand misuse: do not misrepresent yourself as Wildfire; use only approved brand assets.
- Price misrepresentation: do not publish inaccurate or out-of-date prices.

- Maintaining up-to-date account information, including contact details, so Wildfire Oil can reach you as needed. This ensures compliance with the Terms and Conditions and prevents accidental breaches. Failure to update account information may result in account suspension or termination.
10. Compliance with Laws
Adherence to Australian Laws: Affiliates must comply with all applicable Australian laws and regulations, including but not limited to:
Australian Consumer Law (ACL): Prohibits misleading or deceptive conduct and mandates transparent disclosure of affiliate relationships.
Legal123Spam Act 2003: Regulates commercial electronic messages, requiring consent before sending marketing communications.
Acuity MagazinePrivacy Act 1988: Governs the handling of personal information, ensuring data is collected and used lawfully.
Queensland-Specific Regulations: As Wildfire Oil operates in Queensland, affiliates must also adhere to state-specific laws, including:
Fair Trading Act 1989 (Queensland): Aligns with the ACL, emphasizing fair trading practices within the state.
Queensland LegislationLocal Advertising Standards: Ensures all promotional materials meet Queensland's advertising guidelines.
International Affiliates: Affiliates operating outside Australia must comply with their local laws. However, in matters related to the Program, Australian law prevails, and affiliates agree to adhere to its provisions.
Legal Hierarchy: In case of any conflict between local (non-Australian) laws and Australian laws concerning the Program, Australian law will take precedence.
Ongoing Compliance: Affiliates are responsible for staying informed about and complying with any changes in relevant laws and regulations.
11. Term and Termination
- This Agreement begins upon acceptance into the Program and continues until terminated by either party.
- Either party may terminate this Agreement at any time with written notice.
- If you breach any of the terms outlined in this Agreement, Wildfire Oil reserves the right to terminate your account immediately. Upon termination for breach, all earned commissions, including those exceeding the $50 payout threshold, will be forfeited.
- Upon termination, you must immediately cease use of and remove all Special Links, promotional materials, trademarks, and other Wildfire Oil branding from your marketing channels.

Wildfire Oil may share or republish such content on its own websites, social media platforms, marketing materials, and other communication channels, provided proper credit is given to you as the creator (where applicable).
Affiliates retain ownership of their content and may continue to use it for their own purposes.
